Information You Give Us
To use certain features of the Platform (such as buying a painting or registering as an artist), we collect the following personal information:
Identity Details: Name, Age, and Gender.
Contact Information: Mobile Number, Email Address, Billing Address, and Shipping Address.
Seller Data (If applicable): Business Name, GSTIN, PAN Card, and Bank Account details for payouts.
Automatic Collection: We automatically track certain information about you based on your behavior on our Platform to perform internal research on our users’ demographics, interests, and behavior. This information may include the URL that you just came from, which URL you go to next, your computer browser information, and your IP address.
Transactional Info: We collect details of your buying and selling history on the Platform depends on if you are a customer or a seller.
Payment & Financial Information
1. For Buyers (Transaction Data)
When you make a purchase on PaintingKart, we do not store your full credit card number, debit card number, CVV, or Net Banking login credentials on our servers. All financial transactions are processed through secure, PCI-DSS compliant third-party payment gateways.
We only retain limited information necessary for order verification, fraud detection, and refund processing, which may include:
a. Your chosen payment method (e.g., ‘Credit Card’ or ‘UPI’).
b. The Payment Gateway Reference ID and Transaction ID.
c. The status of the transaction (Success/Failure/Pending).
2. For Sellers (Payout Information)
If you register as a Seller/Artist on PaintingKart, we collect and securely store your banking details to facilitate payouts for your sales. This may include:
a. Bank Account Number and IFSC Code.
b. Account Holder Name.
c. UPI ID (if applicable).
d. PAN Card details (for tax deduction purposes as per applicable law).
This information is shared strictly with our banking partners to process your earnings and is encrypted to prevent unauthorized access.
3. Third-Party Processors
By using a third-party payment gateway on our Platform, you agree to be bound by the privacy policies and terms of service of that specific payment processor. We are not responsible for any data security breaches that occur on third-party payment gateway systems.
Use of your Information
We identify and use your IP address to help diagnose problems with our server, and to administer our Platform. Your IP address may be used to identify you and to gather broad information. We may also use your information for legal or regulatory purposes or reach out back to you in case of any potential business opportunities.
We may process certain information of the website’s visitors and analyze it on an aggregated basis. This information may include the URL that you just came from (whether this URL is on our Platform or not), which URL you next go to (whether this URL is on our Platform or not), your computer browser information, and your IP address. For clarity, and notwithstanding anything contained herein, all interactions and transactions outside our Platform are expressly disclaimed from our responsibility or liability (of any kind).
Seller & Artist Public Profile
1. Publicly Visible Information
If you register as a Seller or Artist on the Platform, you acknowledge and agree that certain information you provide constitutes your ‘Business Profile’ and will be publicly visible to all Users of the Platform and visitors on the internet. This includes, but is not limited to:
a. Display Name / Brand Name: The name you choose to operate under (e.g., ‘Art by [Name]’ or ‘Studio [Name]’).
b. Artist Bio & Description: Any personal history, artistic background, or descriptions you provide in your profile settings.
c. Profile Image / Logo: The photograph or logo you upload to represent your store.
d. Portfolio & Listings: Images of your artwork, pricing, and product descriptions.
e. Ratings & Reviews: Feedback and star ratings left by Buyers regarding your products.
2. Purpose of Disclosure
This information is made public to facilitate trust and transparency between Buyers and Sellers, allowing Buyers to make informed decisions about the artwork they purchase. By listing products on PaintingKart, you grant us a non-exclusive, worldwide, royalty-free license to display this information for marketing and promotional purposes.
3. Search Engine Indexing
You understand that your Public Profile and listed artworks may be indexed by third-party search engines (such as Google/Yahoo/Bing etc.) and may appear in search results even if you deactivate your account. PaintingKart has no control over the caching or indexing practices of third-party search engines.
4. Private Seller Data (Not Public)
For the avoidance of doubt, your sensitive financial information (Bank Account details, PAN Card, GST Number) and your private contact details (Phone Number, Email Address) remain confidential and are not displayed publicly on your profile, except where required by law for invoicing purposes.
Cookies
We use data collection devices such as “cookies” on certain pages of the Platform to help analyze our web page flow, and promote trust and safety. “Cookies” are small files placed on your hard drive that assist us in providing our services. Cookies do not contain any of your personal information. Additionally, you may encounter “cookies” or other similar devices on certain pages of the Platform that are placed by third parties. We do not control the use of cookies by third parties. You can also control the use of cookies at the individual browser level, but if you choose to disable cookies, it may limit your use of certain features or functions on the services.
Sharing of Personal Information
We may share personal information internally within PaintingKart group companies, affiliates, related companies and with other third parties for the purpose of providing services offered by them and in general connection to use of this Platform.
We may share these information internally with our PaintingKart Group companies, affiliates, related companies and other third parties for enhancing user experience; for responding to your queries; to comply with our legal obligations; to enforce our Terms of Use; to analyze data on an aggregated level; for identifying any potential business opportunities, which may include schemes and plans which we find relevant to you and your requirements. We may also share these information in case of any mergers, acquisitions or amalgamations; to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to activity in the Platform. We may disclose personal information with law enforcement agencies, third party right owners, if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. However, we do not disclose your personal information to unrelated third parties for their marketing and advertising purposes without your explicit consent. We may share your Name, Delivery Address, and Contact Number with our Courier Partners (e.g., BlueDart, FedEx, DTDC etc.) and the respective Seller/Artist strictly for the purpose of fulfilling and delivering your order.

Our Platform may provide links to other websites from our PaintingKart Group companies or applications that may collect personal information about you. We suggest reviewing their respective Privacy Policies to understand their Privacy obligations before sharing any information.
Security Precautions
We maintain reasonable physical, electronic and procedural safeguards to protect your information. Once your information is in our possession, we adhere to our security guidelines to protect it against unauthorized access. However, by using the Platform, the users accept the inherent security implications of data transmission over the internet and the World Wide Web which cannot always be guaranteed as completely secure, and therefore, there would always remain certain inherent risks regarding use of the Platform.
Children Information
Use of our Platform is available only to persons who can form a legally binding contract under applicable law. We do not knowingly solicit or collect personal information from children under the age of 18 years. If you have shared any personal information of children under the age of 18 years, you represent that you have the authority to do so and permit us to use the information in accordance with this Privacy Policy.
Data Retention
We retain your personal information in accordance with applicable laws, for a period no longer than is required for the purpose for which it was collected or as required under the applicable law. However, we may retain data related to you if we believe it may be necessary to prevent fraud or future abuse, to enable PaintingKart to exercise its legal rights and/or defend against legal claims or if required by law or for other legitimate purposes.

User Account Deletion
Users may request the deletion of their account and associated data by contacting the Grievance Officer as mentioned at the end of this document.
